Immigration Showdown in Harrisburg

“Bring your flak jacket,” joked one staffer to a member of the Harrisburg press corps.

The next two days in the Capitol will be interesting, to say the least. Today and Tomorrow, Pennsylvania House State Government Committee Majority Chairman Representative Daryl Metcalfe will hold two public hearings focusing on the “National Security Begins at Home” legislative package.

Following the introduction of 16 bills in the state House and state Senate this past spring regarding illegal immigration, the coming fall will certainly see a flutter of activity and political dispute as both pro and anti-immigration groups try to push their legislation.

Those testifying this week include law enforcement, think tank thinkers, Tea Partiers, and even those who have been accused of ties to white supremacists.

Metcalfe is a staunch advocate of immigration reform – he even founded a national coalition of like-minded state legislators. He has personally introduced three bills to “halt PA’s illegal alien invasion,” H.B. 738, 857 and 858 to the House. He believes that combating the estimated 140,000 illegal immigrants in Pennsylvania could potentially save tax payers up to four billion dollars. Yesterday, he called an executive order from President Barack Obama “treasonous.”

Civil rights advocates aren’t lying down.

Immediately before the hearing on Tuesday, the American Civil Liberties Union of Pennsylvania joined state legislators and immigration activists for a press conference in the main rotunda of the state capitol in Harrisburg. The group included clergy and labor unions.

Their main argument Tuesday morning: economics. Andy Hoover, legislative director of the ACLU of Pennsylvania, cited cases in Georgia and Arizona, which he argued led to a hit to local businesses.

“Apparently, undermining the constitution and sabotaging our economy begins at the state capitol,” said Andy Hoover, legislative director of the ACLU of Pennsylvania.  “These bills would be a disaster for the commonwealth.”

Two of the bills in the National Security Begins At Home package, H.B. 858 and S.B. 637, include mandates for Pennsylvania governments to use E-Verify. E-Verify is a federal database, handled by the Department of Homeland Security, which allows employers to check the legal status of potential employees.While the use of this system has been voluntary in the past, those who did use it complained of errors and massive privacy concerns. The databases include Social Security numbers, and visa and passport information which is vulnerable to hacking, Hoover said.

Metcalfe’s H.B. 738 includes a clause requiring Pennsylvania law enforcement officers to verify the citizenship status of any individual lawfully stopped for a crime who does not have a state ID or driver’s license. Other legislation cracks down on human trafficking in Pennsylvania, attacks illegal immigrants’ access to public benefits, or intends to hold cities and municipalities responsible for crimes committed by illegal immigrants in that jurisdiction.

The conservative make-up of state government makes it unlikely that pro-immigration groups will find much success. However, those seeking to crack down on immigration may have an equally tough time. Neither GOP party leaders nor Governor Tom Corbett have shown much interest in tackling controversial immigration policies.

  1. The New Legal Form of Racism in the United States

    Prior to the twenty-first century, racism was alive and in the open here in our country. White people used an endless array of racial epithets when talking about people who weren’t of “white” decent. There were institutions formed around the idea of “white supremacy” that tried to spread their message of racism. Prejudice was part of our government, schools, and businesses.

    I grew up a white middle-class suburban neighborhood hearing words like nigger, spic, wetback, beaner, wop, pollak, kike, greaser, jew, dothead, raghead, and the list went on. In those days these words were completely acceptable and often went along with a great many derogatory ethnic jokes told at home and at the workplace. It could have been from a family member, friend, coworker, or the average stranger on the street. We were told that black people were all lazy and shiftless, Puerto Ricans were all knife-wielding gang members, Mexicans were dirty and only good enough to pick fruit, Italians and Polls were plain stupid, and the Jews were cheap money-grubbers.

    Times have changed. Wonderful and amazing things happened here in the last half of the twentieth century. Ethnic groups and women stood up for themselves against prejudice, and white people slowly started to listen and take action. It took two or three generations but Americans replaced hate with tolerance, acceptance with prejudice, and even new words like “Equal Opportunity Employer” and “Politically Correct” became part of the English language. Our schools are ever diligent in promoting the acceptance of our differences in our young people and severely discouraging any form of hate and violence. However, we are still working with many of the same humans of whom racism seems to be hard-wired in their brains.

    Racism wasn’t eliminated; it was only suppressed in the psyche of many Americans. Our society has made racial slurs and epithets completely unacceptable, and illegal, creating laws to cover Hate Crimes when those crimes are perpetrated out of racism. There are many people in this country who bite their tongues and choke back their hate daily in order to appear racially tolerant and accepting, but they wear a mask.

    Racism is far from dead. It has only found a new outlet, a new group to hate: immigrants, foreigners, and especially the people who entered the country illegally. The long-repressed hate is now directed at all of the foreign-born grouped together, with a special emphasis on the undocumented immigrants. Since it is a group of made up of Chinese, Vietnamese, Mexicans, Hondurans, Guatemalans, El Salvadorians, Indians, Pakistanis, and others, it doesn’t appear to be racism on the surface. The haters can now say, “I’m not racist; I hate them all the same,” and they use that to justify their ill will and bad intentions. They can say, “Illegal immigrants are all criminals,” and we are all allowed to hate criminals.

    The same old tactics are used. Lies and half-truths are told. We are told that they crowd our schools and go to school for free when the truth is that schools are financed through property taxes, not wage tax. Even if they are renting the landlord still pays property tax. We are told that they are only looking for a free hand-out when the truth is they work very hard to make a living, and not being citizens, are not entitled to public assistance. We are told that they crowd our emergency rooms when the truth is they only go to the ER if they are close to death since they can’t pay for the care and they risk deportation. We are told they don’t pay taxes when they typically do, at the highest thirty percent rate. We are told they send all of their money home when in fact they need to spend much of it here to live, putting it back into our economy. We are told that immigrants come here to have babies who will be citizens but the truth is that only 0.2% of births were to non-resident mothers. We are told that the immigrants steal jobs from citizens when the truth is the immigrants do the worst jobs that Americans do not want to do.

    The anti-immigration people will throw crime statistics around

    Laws like those in Arizona, Alabama, and Georgia are designed solely to make the lives of the undocumented immigrant exceedingly difficult, to intimidate them, to make them fearful of police, to make them leave on their own, and to justify taking basic human rights away when the undocumented are caught in this neo-apartheid law. The lawmakers claim the laws, “are for the good of the citizens,” when the reality is the laws are based on deep racist feelings. They ignore the benefits that the immigrants bring because they simply do not want the immigrants in their state. It was not long ago that Georgia and Alabama had laws to ensure that whites and blacks were segregated.

    Never once do the anti-immigration people mention the benefit to our economy that comes from these immigrants. They will not tell you that they typically work in the most difficult jobs or that these people put millions of dollars back into our economy, much more than they take away.

    If you spend time talking to the anti-immigration people you will find it very easy to dispel all of the myths and lies that they believe by using solid facts. You will find that they are left with only one single argument: These people entered the country illegally; therefore, they are criminals. They hang there collective hats on that one single argument and hold onto it for dear life.

    The argument then becomes a matter of the severity of the crime to which the anti-immigration people will say it is a serious offense, even if the immigrant has broken no laws since they entered the country. The pro-immigration people will say that it is a victimless crime akin to Jay-Walking while the anti-immigration people cry that they are somehow the victims of the illegal border crossings.

    This is where racism shows through the thin veil. I have learned in life that when someone tells you something but it still doesn’t make sense, they are not telling you everything or they are not telling you the truth. When it can be demonstrated through verifiable facts and figures that immigrants produce more than they take, and yet the anti-immigration people still argue until they are blue in the face that the immigrants are all, “criminals that should be put in jail or sent home,” there is something else going on in their minds. That something is racism, pure and simple and it is still alive in the United States.

    The anti-immigration side tells only part of the story as smoke and mirrors to conceal their true motivations and to give legitimacy to their hate. They only point out the negative exceptions to the rule while they refuse to acknowledge all of the benefits these immigrants bring.

    We have managed to change the hearts and minds of many Americans, but we have only manages to suppress the racism in others. We still have work to do and changes to make.

  2. Two “Dream Activists”, illegal immigrants were invited to testify at this hearing. It is so outrageous that our elected officials would waste one second of taxpayer paid time to hear the contrived demands for amnesty, entitlements, college tuition assistance and citizenship from two illegal immigrants. These two women (Marroquin and Linares) are an embarrassment and affront to all immigrants and their families who had the decency to respect the laws of this nation. It is no badge of honor to be an illegal immigrant and to brag about the many successes one has achieved as a result of a life of illegality and disrespect for our nation’s laws. Cheaters shouldn’t prosper nor be rewarded.

  3. IMMIGRANTS AND TAXES:
    Q: “Is it true that illegal immigrants don’t pay taxes and drain our economy?”
    A: As Ben Franklin said, “Nothing is certain but death and taxes.” Like the rest of us, unauthorized immigrants pay taxes on their property and anything they buy. More than half of them have taxes taken out of their paychecks, but because our immigration system is dysfunctional, these taxes are paid under false Social Security numbers. We need a new regimen in which we know who is paying taxes and can ensure that no one is getting a free ride. The only way to do that is to pull unauthorized immigrants out of the shadows and get them on the right side of the law.
    Three state-level studies have found that unauthorized immigrants pay more in taxes than they use in benefits. In Iowa, unauthorized immigrants pay an estimated $40 to $62 million in state taxes, while they and their employers contribute an additional $50 million to $77.8 million in federal, Social Security, and Medicare taxes from which they will never benefit. In Oregon, unauthorized immigrants—who are not eligible for any state benefits—pay between $134 million and $187 million in taxes each year. Finally, in Texas, the State Comptroller found that, without unauthorized residents, the gross state product in 2005 would have been $17.7 billion less.

    THE BOTTOM LINE: Undocumented immigrants are an important component of the U.S. economy. They meet the labor demand in sectors in which they do not directly compete with U.S.-born workers. The great majority of migrant workers are taxpaying, hardworking, and law-abiding people who are integrating into U.S. society.

    The economics of immigration, Stephen C. Goss, the chief actuary of the Social Security Administration and someone who enjoys bipartisan support for his straightforwardness, said that by 2007, the Social Security trust fund had received a net benefit of somewhere between $120 billion and $240 billion from unauthorized immigrants.
    That represented an astounding 5.4 percent to 10.7 percent of the trust fund’s total assets of $2.24 trillion that year. The cumulative contribution is surely higher now. Unauthorized immigrants paid a net contribution of $12 billion in 2007 alone, Goss said.

    Previous estimates circulating publicly and in Congress had placed the annual contributions at roughly half of Goss’s 2007 figure and listed the cumulative benefit on the order of $50 billion.

    The Social Security trust fund faces a solvency crisis that would be even more pressing were it not for these payments.
    Adding to the Social Security irony is that the restrictionists are mostly OLDER AND RETIRED WHITES from longtime American families. The very people, in other words, who benefit most from the Social Security payments by unauthorized immigrants.

    Comprehensive Immigration Reform Would Boost the Economy & Help ALL American Workers: As opposed to the mass deportation, enforcement-only approach, addressing and fixing the immigration system in a wholesale manner will be a boon to the U.S. economy and all U.S. workers. That is why both the AFL-CIO and Change to Win created The Labor Movement’s Joint Framework for Comprehensive Immigration Reform. Dr. Raúl Hinojosa-Ojeda conducted a 2010 report for the Center for American Progress and the Immigration Policy Center that found that “Unlike the current enforcement-only strategy, comprehensive reform would raise the ‘wage floor’ for the entire U.S. economy—to the benefit of both immigrant and native-born workers.” According to the study, granting legal status to undocumented immigrants and creating flexible legal limits on future immigration flows would generate enough consumer-spending to support 750,000-900,000 jobs. The report also found that the mass deportation approach would reduce GDP by 1.46 percent annually, amounting to a loss of $2.6 trillion over 10 years.

    UNDOCUMENTED IMMIGRANTS ARE NOT CRIMINALS. Its a Civil Matter.

    The whole thing is perplexing to people who don’t understand that being an illegal immigrant in and of itself is not a crime. The most pervasive comments made in news stories about Secure Communities go a little like this: “Illegal immigrants are what they’re called — they’re considered criminals by mere definition. Illegals who broke a bunch of laws to enter and live here should be subjected to immediate arrest and deportation — that’s fair for everyone.”

    That’s not accurate, but a lot of people have that same misunderstanding — even law enforcement professionals.

    During a teleconference last month on the troubles that Secure Communities is bringing to local law enforcement agencies, a few sheriffs on the call commiserated about their misunderstanding of immigration violations.

    “I was always told it was a felony federal violation of law and was always under the impression that turning over any illegal immigrants (to ICE) was mandated by federal law — and so did my employees,” said Sheriff Ed Prieto of Yolo County, Calif. “But after we met with the Mexican consulate in Sacramento we learned it’s not. Then I started looking into how many of our people are being deported before trial and I became very uncomfortable contacting ICE for nonviolent offenders.”

    Kane County, Ill., Sheriff Patrick Perez said that “90 percent of law enforcement officers believe (just being an illegal immigrant) is a crime, but I learned after talking to an immigration judge that it is just a civil offense.”

    Sara Dill, a member of the American Bar Association’s Commission on Immigration and a member of the ABA’s Criminal Justice Council, explained it to me this way: “States are seeking to criminalize what is only a civil violation in federal law.” Dill said that failing to get a permit for home construction is one example of a civil, not criminal, violation. “Putting illegal immigrants in a criminal context confuses merely being present in the United States without authorization with crimes such as falsely claiming citizenship or identity theft, which are crimes under federal law.”

    Everyone knows that of the universe of illegal immigrants, some have committed nonviolent and violent crimes — and everyone believes these should be prosecuted to the full extent of the law.

    But believers of following “the letter of the law” cannot continue equating all illegal immigrants living in this country with criminals, who have plenty of civil rights of their own. That’s not the American way.

The nonpartisan Congressional Budget Office scored the bi-partisan 2007 comprehensive immigration reform bill that was proposed in the Senate as increasing federal revenues by $15 billion over the 2008-2012 period and by $48 billion over the 2008-2017 period.

    In addition to expanding our tax base, economists have proven that comprehensive immigration reform would also increase wages for native workers, thereby boosting tax revenues generated by all workers. The CATO Institute found that forcing undocumented immigrants to get right with the law by registering with the government would boost the incomes of U.S. households by $180 billion in 2019, which would also lead to increased government revenues, without increasing tax rates.

    Just like our budget deficit, immigration reform is an issue that we cannot afford to ignore. Bipartisan proposals that are tough, fair, and practical have garnered support from across the ideological spectrum in Congress, as well as from President Bush and the current administration. Comprehensive immigration reform would clearly help us reduce our deficit and debt, and would do so without raising tax rates.

  8. It was an unexpectedly excellent first day of hearings. I was very impressed with the witnesses with the exception of one, a cowardly liar by the name of Kay Hollenbough, a farmer who admitted to the Committee that she KNOWINGLY hires illegal aliens (she called them “immigrants”). I was looking around the chamber for an ICE agent with handcuffs and an orange jumpsuit at the ready! Berks County Sheriff Eric Weaknecht was an outstanding witness. He reminded me of a young Sheriff Joe! Can’t wait to see the second day of hearings tomorrow!

    Why does 95% of the media leave out “illegal” to misrepresent the facts. Pro-immigration and anti-immigration is a cover for “pro-criminality and anti-criminality.” If ten years ago someone would have told you pro-illegals and anti-illegals were getting together to hash things out, you would think they were talking about a third world country without laws.

  13. Never will we get a straight truth from Democrats who believe our borders should remain open? Neither have we got the specifics from the Liberal oriented media. So many articles are missed by the general public, because the Leftist press chooses to blackout different factual articles, as it would add ammunition to securing the border. For instance according to an “American Patrol” in today’s report, that on June 18, 2010, Arizona Republican Senator Jon Kyl told the audience at a North Phoenix Tea Party town hall meeting that during a private, one-on-one meeting with President Obama in the Oval Office, the President told him, regarding securing the southern border with Mexico, “The problem is… if we secure the border, then you all won’t have any reason to support ‘comprehensive immigration reform.'” There is a video of Senator Kyl saying exactly these words at the TEA Party convention at “Vision for American” website.

    I have found that many websites frown on web addresses, but you can locate these very serious information articles at American Patrol, NumbersUSA and the conservative legal website Judicial Watch, by typing these web sites into Google. The websites don’t pull punches and are very explicit in intelligence on illegal immigration and other political news not revealed in the Liberal predisposed news reports. These articles in the majority of cases are backed by hard facts, such as the Los Angeles Times ignoring the report about the tunnel under our Southern Border. Its, Liberal bias runs parallel to the Arizona Republic. This media are not separate on the belief, that the way between Mexico and our sovereign nation should be wide open. They are citing that because of these tunnels under our border, is sufficient evidence that the fence doesn’t work. The fact is it does work? Otherwise they wouldn’t build tunnels?

    If the border fence was constructed according to Rep. Duncan Hunter’s design of two parallel fences with roads and watchtowers, in between, adorning the two thousand miles with concertina razor wire. This would stop the invasion by economic aliens from across the border. Trouble is the fence remains open in so many areas covering hundreds of miles. Deployment of 5000 National Guard along the fencing would halt for good these everyday incursions into our country. Not only would it would dissuade thousands turning up every month, including females pregnant; intentionally entering America to have free reign to our welfare programs for citizens. Taxpayers could begin to save billions of dollars in the educational, health care and prisons, all overcrowded with illegal aliens. Mexico is saying that the influx of their native-born has dwindled, but when the actual Mexico cities politicians handed out guide book to slip past the US Border Patrol, who are you inclined to believe? In any case we are already supporting 20 million plus alien foreigners from across the world. A government National ID card could put an end to the illegal immigration occupation.

    In the political pit that is the Senate and Congress, you cannot expect to close the loopholes in immigration, as the Democrats driven by the Liberals want future votes. Then the Republican establishment likes the unceasing flow of migrants for cheap slave labor, so they don’t have to pay a full measure of pay and benefits to Citizens and legal residents. It is the same with the farms and mega agricultural acreage. Cheap labor in the fields, service industries, manufacturing, and construction want no changes to the laws. They certainly don’t want the 1986 Immigration laws enforced, because none of them could exploit the millions already here or those who are encouraged to come here across borders or through an aircraft terminal. Our immigration policies are a mess, because they are not enforced. That why America has a yearly deficit of 113 billion dollars and no politician has placed a bill on the table to halt the $46 Billion dollars a year going to other foreign lands in illegal worker allotments. That $113 billion dollars is not going to remain the same forever, but it rising every year to new heights.

    Behind all these illegal immigration issues and the open border agenda is money. It’s just plain greed spawned by both parties. The majorities of lawmakers are not interested in the American people’s rights, interests or will. But it’s in the people’s interest to restrain these legislators who would approve another ugly mass amnesty. We cannot afford another Immigration Reform package from either party, as we have already been bled to a husk by those already illegally settled here. Just think the political high echelon already served us on a plate, to raise the $14.6 Trillion debt ceiling to a new high, by another $2.Trillion dollars. In California, a Sanctuary State they are ready to close down 70 State parks, but the Liberal Governor Jerry Brown thinks nothing of pushing forward with a State Dream Act. Another cost for this ailing State one way or another, when they are trying to cut down on their impossible deficit of $26 Billion dollar.

    It only makes sense to give the TEA PARTY leadership a chance to resolve what’s wrong with America. The TEA PARTY could not do any worse than the majority of corrupt fools running in office now? My point of view is people like Billionaire Donald Trump, Michele Bachman or Herman Cain, have straight forward idea to resurrect America from the organized-chaos that is Washington. Rick Perry has a poor thought process on illegal immigration, as he thinks we should graduate to another amnesty. The 1986 Immigration Control and Reform Act didn’t work, so another move towards a Congressional bill would be a travesty; played on the American people. The TEA PARTY will return empowerment to the people and each individual State, such as education. It will end strong armed agencies as the (EPA) Environmental Protection Agency that is killing jobs, with too many regulations.

    We need a moratorium on all regulations, to give thousands of companies’ breathing space such as the Coal industry. Coal supplies much of our energy to our communities, but many are closing down because of the immense pressure from regulatory controls. The Department of IN-Justice seems to have the federal courts in their pockets, so immigration laws are carefully engineered to undermine the policing laws enacted in Arizona, Georgia and Alabama. There are millions of Americans without jobs that are angry and frustrated with the political ideology, that the government has inept in closing the borders or enforcing immigration laws, but are covering up this fact by going after states who are floundering in unfunded mandates for entitlement payments to illegal aliens and their children.

    I happened to find this commentary that really sums up the problem with illegal immigration in a website commentary.

    We are persistently told that ILLEGAL ALIENS “are just here to work”, but at the same time told that “they only take jobs Americans wouldn’t do anyway.” Hogwash! The ironic thing is just WHOSE jobs they’ve actually taken. ILLEGALS now occupy most of the unskilled entry-level jobs that inner-city youths used to start out with. All the Construction, Light Manufacturing, and Agriculture jobs that poorly-educated Blacks (and Whites) used to gravitate to have been taken over by Illegal’s. They have literally crowded out independent Union contractors and craftsmen in the building trades – I personally know two roofers and a drywall’s who each closed their businesses after being continually underbid by unlicensed, non-union Illegal’s. They could not pay all their taxes, insurances, licensing fees, and union dues, and still compete with an Illegal who has no more business overhead than the tools in his toolbox. Illegal’s all work “under the table”, so they don’t pay ANY of those overhead costs, so they can always afford to underbid a dues-paying, licensed craftsman. I say its “ironic” whose jobs they steal, because two of Mr. Obama’s strongest supporters are Blacks and Union members, and they are PRECISELY the two groups his Administration’s immigration policies are screwing over the most, all in hopes of bringing in more lifetime Democrats.

    So everybody who cares about America’s economy and future should join their local or the central Tea party. Locate your federal, State and community representative and ask them directly their stance on this very expensive issue, which influences all our taxation.
