PA-Gov: Work Documents for Tomalis Unavailable Under Open Record Law

TomalisThe Campaign for a Fresh Start, a political committee formed by Tom Wolf, was denied access to work records and contracts of Ron Tomalis, the former Education Secretary.

The committee had been trying to gain access to the records from Tomalis’ 15-month tenure, when he was paid $139,000 a year. They wanted progress reports, employee evaluations, performance reviews, and performance improvement plans. The documents, however, are not available under the Right to Know Law.

Tomalis resigned from his position as special advisor to the Governor in August, after a report by the Pittsburgh Post-Gazette revealed he had done little work despite being paid a hefty salary.

“Tom Wolf’s campaign is seeking documents they know either do not exist or, by law, are confidential and cannot be released, to distract from Wolf’s proposal to raise Pennsylvania’s income tax”, said Chris Pack, communications director for Tom Corbett.

Larry McComsey, the Education Department’s open records officer said, “All other records sought are exempt from access under the open records law.”

Fresh Start, however, does not believe Corbett is telling the truth.

“It shows they’re covering something up,” said Mike Mikus, spokesman for Fresh Start. “They’ve yet to show Ron Tomalis actually worked to support that salary. If Ron Tomalis was a real employee, how is it possible that he lacks a single employment document? It is long past time for Tom Corbett to explain to Pennsylvania taxpayers why he wasted their money on a ghost employee.”

The Education Department has released time-stamped records showing Tomalis’ employee pass was used regularly to log in and out of the Capitol garage during his time as Education Secretary.

Carolyn Dumaresq, Acting Education Secretary, previously vouched for Tomalis and said he was working when he held the position.

  1. The heck with logging in and out of the garage. Check how many times and when he logged into his Commonwealth computer. Check how many key strokes were done on his computer. ASk employees to sign witness statements about his comings and goings. The capability is there and has been used and there is probably other stuff that can be checked that is secret.

  4. You have to give it to PAINDY1: he was onto the Tomalis scam like a hound dog on convicts. If only we had an independent, industrious press corps, this story would have been exposed long ago. Instead, a lonely, courageous voice from the wilderness through persistence verging on obsession has unveiled the cancer at the heart of the education establishment. Where are the prosecutors paid for with taxpayer salaries? Where are the police investigations, the grand juries, the editorial boards? PAINDY1 has earned the BLOGGER PULITZER AWARD.
