Pa. Republicans File for Stay of State Supreme Court Maps

State Senate and House Republican Leaders filed an appeal with the U.S. Supreme Court to stop the implementation of the new Congressional map drawn by the state Supreme Court.

State Senate President Pro Tempore Joe Scarnati and state House Speaker Mike Turzai filed an appeal with the U.S. Supreme Court seeking a stay of the state court’s decision before the new maps were released which was denied.  They believe they have a stronger case now that they court redrew the maps.  

“State Senate and House Republican Leaders filed an appeal with the U.S. Supreme Court to stop the implementation of the new Congressional map drawn by the state Supreme Court,” Scarnati said.  

Turzai said that the state court’s decision could lead to chaos down the road if the Supreme Court does not issue a stay.  

“In allowing the Pennsylvania Supreme Court to invalidate federal congressional lines and to draw lines of their own, the U.S. Supreme Court will allow chaos to ensue throughout the United States in the coming years where politically connected litigants can go running into state Supreme Courts to invalidate congressional maps,” Turzai wrote in an op-ed.  

The petitioners who filed the original lawsuit that lead to the maps being redrawn called the filing a waste of time.  

“At the risk of repeating ourselves, there was no good argument three weeks ago, and there is no good argument now for the U.S. Supreme Court to step in and undo a final judgment and remedy issued by the Pennsylvania Supreme Court,” Stanton Jones, Partner with Arnold & Porter who is representing the petitioners said.

Article 1, Sec. 4 of the U.S. Constitution states: “The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Place of Chusing Senators.” There’s nothing in that Article that states that the State Supreme Court CAN draw Congressional Districts!
