Shapiro Sues Trump Over Contraceptive Care Decision

Josh ShapiroAttorney General Josh Shapiro is continuing his push back against the Trump administration’s decisions by filing a lawsuit over the administration’s decision to end guaranteed contraceptive coverage for women.  

“The federal government – under the direction of the Trump Administration – broke the law and undermined the health and economic independence of American women,” Shapiro said in a release announcing the filing.  

The case was filed in in the U.S. District Court in Philadelphia.  Shapiro argues that the decision violates the 5th Amendment, the Pregnancy Discrimination Act and Title VII of the Civil Rights Act of 1964, the Establishment Clause of the 1st Amendment, and the Administrative Procedure Act.  

“As a result of these abuses, which replace evidence-based science and medical reasoning with political calculation, millions of women could be penalized and denied needed contraceptive care against the advice of science, public health and medical professionals,” Shapiro said.  

Earlier this year, Shapiro joined 18 other states in suing U.S. Education Secretary Betsy DeVos over her decision to rescind the Borrower Defense Rule.

  1. They report when he sues because they think of Shapiro has a “ brave progressive fighting against an evil tyrant.” They may not say it, but it is what they think. When he loses, there will be only a 30 report on 1 local news channel and about a two sentence summary in a major newspaper.

  2. So yet again we have Shapiro wasting taxpayer money on a lawsuit he knows he won’t win just so he can pad his resume and impress the Democrat party bosses and big donors when he runs for Governor in 2022. What a sleaze.

  3. Viewed purely from the non-political, legal perspective, it is unclear how he can claim this is an essential entitlement; viewed broadly from the ideological, lib-based perspective, it is clear he is planting gubernatorial seeds.

  4. Let’s hope not. Trump handles the law as of it’s his private business. One of the lessons of America is the rule of law, not just personal preference.

    1. Exactly. This decision is as crazy as it is stupid. Contraceptives are used to treat a number of medical issues from endometriosis to migraines in addition to helping dramatically reduce the number of unwanted pregnancies. This decision, if allowed to stand, will result in more sick women and more completely avoidable abortions, hurting the health and welfare of women as well as economic productivity. And it isn’t exactly helping Republicans with the image that they see women as second-class citizens.
