Trump Passes Over PA Judge Hardiman for SCOTUS

Judge-Hardiman-2President Donald Trump announced this evening that 10th Circuit U.S. Court of Appeals Judge Neil Gorsuch would be his nominee to the Supreme Court.  

Gorsuch beat out Pittsburgh-based Judge Thomas Hardiman for the nomination, after the two of them had been named to the final two.  Trump chose Gorsuch despite Hardiman receiving the endorsement of Trump’s sister, Judge Maryanne Trump Barry.

Hardiman may still be a contender for a future nomination later in Trump’s term. During the campaign, analysts said the next President could choose up to four new Justices.

  6. I grant that Hardiman offered some diversity of background as a first-generation college grad, but I wouldn’t say Georgetown Law would have made the court more educationally diverse. Having Justices who went to elite law schools is not a bad thing, so we should be striving for diversity of life background and experience rather than focusing on where someone got a three-year degree of which the substance is very similar across most schools.

  8. It’s the politics of necessity. Trump was playing to the Evangelicals with his choice of Gorsuch. And so far they seem to be very happy with Trump’s nominee.

    I hope Hardiman has another chance at a SCOTUS seat, as he is eminently qualified. Trump is likely to fill another vacancy before 2020, and Hardiman could well be the nominee for that.

The lack of such “diversity” on a multi-member appellate court is not and should not be of any concern. The law is the law. Judges read the law and give it effect. A judge’s capacity to do this has nothing to do with, for example, her unique experiences as “a wise Latina woman” or his attendance at Temple instead of Harvard.
